Litigation and Bankruptcy Practice

Mike Migliore has substantial experience in litigation, having practiced throughout Delaware's Courts, both at the state and federal level.  During Mike’s years of corporate bankruptcy experience, he has represented a wide array of clients, including numerous chapter 11 corporate debtors, creditors’ committees, insurance companies, asset purchasers, institutional lenders, private equity firms, landlords and individual creditors, as well as plaintiffs and defendants in many adversary proceedings. 

Mike is certified as a mediator by the Delaware Superior Court, and he is the Chair of the Alternative Dispute Resolution Section of the Delaware State Bar.  Mike mediates commercial disputes, helping his clients to resolve disputes economically and efficiently through alternatives to traditional litigation.

Mike served as an extern to The Honorable Joseph J. Farnan Jr. (retired) of the U.S. District Court for the District of Delaware.

Government Relations and Consulting

Mike is former counsel to the House of Representatives of the Delaware General Assembly and a former legal aide to then-United States Senator, now Vice President, Joseph R. Biden, Jr.  Mike has a firm grasp of the rules of the legislative process, a strong sense of how the institutions of government operate and a solid understanding of what works and what doesn’t.

Mike provides government relations and consulting services at all levels of government.  With his experience, Mike offers a unique combination of benefits that are designed to further clients’ business goals by minimizing political risk, developing new markets and taking advantage of strategic opportunities.

Mike supports clients by:

  •  Shaping legislation and government policy to achieve positive outcomes through advocacy with key decision-makers, including legislators, administration officials and key staff. 
     
  •  Monitoring, analyzing and reporting on legislative and regulatory developments.

  •  Drafting legislation, position papers, agency comments and testimony.

  •  Crisis response and reputation management, which involves addressing the client’s immediate strategic and political needs while ensuring that the client’s brand is protected in the long term and their point of view is understood by key decision-makers.

  • Preparing witnesses for hearings, testifying on behalf of clients before legislative bodies, and representing clients in legislative and administrative investigations.

  • Assisting in preparation of grant applications.
