Rob gained admission to the Delaware bar in 2000, joined the firm in 2004, and became a partner in 2010. He practices in Delaware’s state and federal courts, and focuses his practice on corporate and alternative entity litigation in the Court of Chancery, civil litigation in Delaware’s Superior Court and the United States District Court, and appellate litigation in Delaware’s Supreme Court.  Rob clerked in the Superior Court for The Honorable Joseph R. Slights, III during the 2000 and 2001 term.                 

Rob is a co-author of Automobile Injury and Insurance Claims: Delaware Law and Practice, a widely circulated treatise first published in 2003 and supplemented annually. This treatise is used extensively by Delaware attorneys, as well as members of the bench and the insurance industry.

 

Representative Cases

State Farm Fire & Casualty Co. v. Middleby Corp., 2011 WL 1632341 (Del. Super.). The Superior Court entered summary judgment in two related cases involving fires allegedly caused by defective fryers.

 

Sanders v. Ohmite Holdings, LLC, 17 A.3d 1186 (Del. Ch. 2011). The Court of Chancery entered summary judgment in favor of a plaintiff seeking access to corporate books and records under Section 18-305 of  Delaware’s Limited Liability Company Act.

 

Katz v. APFS LLC, Del. Ch., C.A. No. 5733, Laster, V.C. (Jan. 25, 2011). The Court of Chancery denied a motion to dismiss this action seeking advancement of legal fees and “fees-on-fees” under  the company’s operating agreement.

 

Deuley v. DynCorp International, Inc., 8 A.3d 1156 (Del. 2010). The Superior Court entered summary judgment in favor of several defendants based on provisions in the employment contracts of civilian police officers employed in Afghanistan in this negligence, wrongful death, and survival matter (Deuley v. DynCorp International, Inc., 2010 WL 704895 (Del. Super.)), and the Supreme Court affirmed that decision.

 

Gentile v. Rossette, 2010 WL 2171613 (Del. Ch.). The Court of Chancery entered judgment after trial in favor of corporate shareholders asserting that the defendant directors breached their fiduciary duties to the shareholders. This decision came after the Supreme Court reversed a prior entry of summary judgment in favor of defendants. Gentile v. Rossette, 906 A.2d 91 (Del. 2006).  

           

Miller v. State Farm Mutual Automobile Insurance Co., 993 A.2d 1049 (Del. 2010). The Supreme Court reversed and remanded this insurance and person injury matter for a new trial based on the trial court’s application of the collateral source rule.

 

In re Trados Inc. Shareholder Litigation, 2009 WL 2225958 (Del. Ch.). The Court of Chancery denied a motion to dismiss this class action alleging that Trados’ directors breached their fiduciary duties to the company and its shareholders during a merger.

 

Doe v. Cahill, 884 A.2d 451 (Del.). The Supreme Court established the circumstances under which a defamation plaintiff may force an internet service provider to disclose the identity of individuals making anonymous statements on the internet.
